Terms of Service
Effective Date: August 15, 2026. Please read these terms carefully before using the PostSpoke platform.

Acceptance of Terms & Eligibility
By creating an account, accessing, or utilizing the PostSpoke web application, mobile application, APIs, or related services (collectively, the "Service"), you acknowledge that you have read, understood, and agree to be bound by these Terms of Service. If you are entering into these terms on behalf of a company, organization, or other legal entity, you represent and warrant that you have the authority to bind such entity.
You must be at least 13 years of age (or 16 in certain jurisdictions) to access the Service.
You must provide accurate, current, and complete registration information during signup.
Continued use of PostSpoke after updates to these terms constitutes binding acceptance of the revised terms.

Account Registration & Credential Security
You are responsible for maintaining the strict confidentiality of your login credentials, multi-factor authentication devices, and account passwords. You accept full responsibility for all activities, publications, and API operations that occur under your account.
You agree to immediately notify PostSpoke at postspoke@gmail.com upon discovering any unauthorized access or breach of security.
PostSpoke will not be liable for any loss or damage arising from your failure to safeguard your account credentials.
Shared or compromised accounts may be temporarily locked or suspended for security verification.

Free Public Beta Access & Future Commercial Subscriptions
During our public Beta testing period, all PostSpoke features, multi-platform publishing, and connected accounts are provided 100% free of charge with no credit card required.
Beta Access: Early adopters receive complete, unconstrained access to all features at zero cost for the duration of the public Beta.
No Hidden Charges: You will not be billed during the Beta period. No payment method or credit card is required to register or use the Service.
Future Commercial Launch: When commercial subscription plans launch in the future, all beta users will receive advance notice and an exclusive lifetime discount before any paid plan takes effect.
Plan Flexibility: Once commercial plans launch, users may upgrade, downgrade, or cancel their subscription preferences at any time from their profile settings.

Acceptable Use & Content Ownership
You retain full intellectual property ownership and copyright of all text, images, videos, audio, and documents ("Content") you upload, draft, schedule, or publish through PostSpoke.
You grant PostSpoke a limited, worldwide, non-exclusive license solely to transmit, process, format, and publish your content to your connected social channels as instructed.
You agree not to publish illegal, defamatory, hateful, abusive, or infringing content.
You agree not to use automated bots, scrapers, or exploits that circumvent platform rate limits or degrade service quality for other creators.

Third-Party Social Platform API Compliance
PostSpoke integrates directly with third-party social networks and publishing destinations (including X/Twitter, LinkedIn, Meta/Facebook/Instagram, YouTube, Bluesky, Mastodon, TikTok, Substack, Medium, and WordPress).
You agree to comply with all terms of service, developer policies, and community guidelines of each linked social network.
PostSpoke is not responsible for publishing delays, account suspensions, or rate-limit rejections imposed by external social platforms.
You may revoke OAuth permissions and disconnect social accounts from your PostSpoke settings at any time.

AI Content Generation & Assistant Tools
PostSpoke provides integrated artificial intelligence tools to assist with content ideation, drafting, hashtag suggestions, and tone formatting. Output generated by AI is provided for creator assistance.
You are solely responsible for reviewing and verifying the accuracy and appropriateness of any AI-generated drafts prior to scheduling or publishing.
We do not claim ownership of content created using our AI assistant features.
You agree not to use AI generation tools to produce spam, disinformation, phishing schemes, or malicious material.

Service Availability, Uptime & Modifications
We strive to maintain a 99.9% service uptime for our core scheduling infrastructure, web application, and API publisher services.
We reserve the right to perform routine maintenance with advance notice where practical.
We may introduce new features, improve tools, or deprecate outdated integrations as third-party APIs evolve.
PostSpoke shall not be liable for temporary network disruptions caused by upstream cloud providers or internet transit issues.

Limitation of Liability & Disclaimers
To the maximum extent permitted by applicable law, PostSpoke and its affiliates, officers, and employees shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, audience reach, data, or goodwill, arising from your use of the Service.
The Service is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express or implied.
Our aggregate liability for all claims related to the Service shall not exceed the total amount paid by you to PostSpoke during the 12 months preceding the event.

Account Termination & Data Export
You may terminate your account at any time via your Profile & Security settings. Upon account closure, all active recurring billing will cease immediately.
You may export your post history, analytics reports, and media library prior to account deletion.
We reserve the right to suspend or terminate accounts that violate these terms or engage in fraudulent activities.
Upon permanent deletion, all OAuth tokens, credentials, and draft posts are purged from our active databases in accordance with our Privacy Policy.

Governing Law & Legal Inquiries
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law principles.
Any disputes arising from these terms shall be resolved through binding confidential arbitration.
